General Terms & Conditions

§ 1 Scope and Provider

These General Terms and Conditions (GTC) apply to all orders placed with the online shop at marispyperstudios.com.

The contract language is English. You can retrieve and print the current GTC on our website. We do not store the contract text for you beyond what is necessary to process the order.

§ 2 Conclusion of Contract

The presentation of goods in the online shop is a non-binding invitation to order. By clicking “Buy” you submit a binding offer to purchase. Before submitting, you can review and correct your data. We accept your offer either by order confirmation or by dispatching the goods. The contract is concluded at the time of the first of these events. Automatic order-receipt emails are not an acceptance.

§ 3 Prices

The listed prices are final prices plus shipping costs. Pursuant to § 19 UStG, we do not charge or display VAT due to our small business status (Kleinunternehmerregelung).

§ 4 Terms of Payment; Default

The following payment methods are available: Credit Card, PayPal, and Klarna (where available). We reserve the right to determine which payment methods are available for each order based on factors such as order value, destination country and risk checks. For credit card and PayPal/Klarna payments, the transaction is processed by the respective provider according to their terms.

§ 5 Delivery; Retention of Title

Unless otherwise agreed, goods are delivered from our warehouse to the address you specify.

We ship worldwide, but only in quantities typical for household use.

Ownership of the goods remains with us until the purchase price is fully paid.

We are not obliged to deliver the ordered goods if we have properly ordered them ourselves but have not received timely or correct delivery (congruent hedging transaction). This applies only if we are not responsible for the unavailability and have informed you promptly. In such cases, we will immediately refund any payments made. We do not assume the procurement risk for generic goods or items described by type and characteristics.

§ 6 Right of Withdrawal

**Right to withdraw**

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day you or a third party named by you, who is not the carrier, have taken possession of the goods. If the order consists of multiple goods delivered separately, the period starts when the last good is received. To exercise your right of withdrawal, send a clear statement (e.g. email) to design@marispyperstudios.com.

**Effects of withdrawal**

If you withdraw, we reimburse all payments including the cost of standard delivery without undue delay and at the latest 14 days from the day we receive your notice of withdrawal. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent them back. Refunds are made using the same payment method unless otherwise agreed. You must send back the goods within 14 days from the day you notify us of the withdrawal. You bear the direct cost of returning the goods. If you use our prepaid return label, we deduct the label cost from your refund: €5 (DE) / €15 (EU) / €25 (Rest of World). Returns of faulty goods are free of charge for you. You are only liable for any loss in value of the goods if this loss is due to handling not necessary to establish the nature, characteristics and functioning of the goods.

**Exclusions**

The right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalised.

§ 7 Damage in Transit

If goods are delivered with visible transport damage, please report this immediately to the delivery person and contact us as soon as possible. Failure to report such damage does not affect your statutory warranty rights but helps us assert claims against the carrier or insurer.

§ 8 Warranty

Your warranty claims are governed by statutory provisions (§§ 433 ff. BGB).

If you are a consumer (§ 13 BGB), the limitation period for claims regarding **used goods** is **one year**. This does not apply to claims for damages due to injury to life, limb or health, or for damages caused by intent or gross negligence. For **new goods**, the statutory two-year period applies (§ 438 (1) No. 3 BGB).

§ 9 Liability

We are liable without limitation for intent, gross negligence, and damages resulting in injury to life, limb, or health. For slight negligence, we are only liable for breaches of essential contractual obligations (cardinal obligations). In such cases, liability is limited to foreseeable damages typical for the contract.

§ 10 Alternative Dispute Resolution

We are neither willing nor obliged to participate in consumer dispute resolution before a consumer arbitration board. Note: The EU Online Dispute Resolution (ODR) platform was discontinued on 20 July 2025.

§ 11 Final Provisions

German law applies; CISG excluded. Mandatory consumer protection law of the country of your habitual residence remains unaffected.

(Optional for B2B:) For merchants, legal entities under public law, or special funds under public law, the place of jurisdiction is Berlin.
